SECTION 1 - TERMS AND CONDITIONS

Please read these Terms and Conditions of Sale carefully before using the website of Kiddie Couch  (https://www.kiddiecouch.ca) (referred to in this document as “website”, “we”, “us”, “our”). These terms apply to all buyers, customers, visitors, users, and others (collectively referred to as “users” and “you”) who have access to our services. Through our website, we may offer our services which include but are not limited to products, software, tools, links, alerts, (hereby collectively known as “services”). By using our website, you as a user hereby accept these terms and should cease using the website if you are not agreeing with any of the terms stated on this page.

 

SECTION 2 - USE OF OUR WEBSITE

2.1 Eligibility

As a condition of your use of the website, you agree that:

  1. You are mentally capable of making your own decisions;
  2. You are not a minor;
  3. You can create a binding legal obligation;

SECTION 3 - PAYMENT POLICY OF KIDDIE COUCH

Whenever you shop from our website and use our services, it will be according to the rules and regulations. The customer must pay the price of the product as stipulated on the product before the order is processed and unless otherwise advertised all payments will be paid in full. The prices displayed on our website will be considered final and the customers are required to pay that price. The customers can select any of the payment methods provided by the Shopify platform.

Mainly, these methods include:

  1. PayPal
  2. Apple Pay
  3. Google Pay
  4. Visa/Master - Credit & Debit Cards
  5. American Express - Credit Cards

Disclaimer of Liability

While availing any of the payment methods offered by us, we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you including but not limited to the following :

  1. Lack of authorization for any transactions since all payments will be processed through Shopify.
  2. Exceeding the preset limit mutually agreed upon by you and between your banks.
  3. Any payment issues arising out of the transaction.
  4. The decline of transaction for any other reasons.

 

SECTION 5 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

 

SECTION 6 - SHIPPING POLICY

This Shipping and Delivery Policy applies to the products purchased through our website. Our aim is to deliver all of our products in perfect condition to our valued customers. We will deliver our products according to the terms and conditions of the following shipping policy. This shipping policy doesn’t constitute or confer any legal right between our website and any customer. We reserve the right to change this shipping policy anytime without any notification. Please note that the orders will be delivered to the delivery address that you provided on the checkout page, so it is important that you pay special attention when completing the delivery address data. We will not be held liable if the delivery address is incorrect or incomplete.

6.1.      Coverage Of Shipping Areas

We deliver all over the Canada and USA. Orders will be shipped as soon as the order is processed and payments have been verified.

6.2.      Shipping Rates And Carriers

We use the logistic services of Canada. The shipping charges will be calculated at the checkout page based on the method of shipping option.

6.3.      Shipment Processing Time And Tracking

We will provide the tracking numbers, between 1 - 3 business days after the order is placed. Once your order has been sent, a notification will be sent to your registered email address. This notification will have a tracking number through which you will be able to track your order. The processing time for order delivery may vary depending on the location.

 6.4.     Possible Delays In Shipping Process

Deliveries that are delayed due weather conditions, environmental or dangerous goods incidents, perils of the air, public enemies, public authorities acting with actual or apparent authority, application of security regulations imposed by a government or otherwise applicable to the shipment, acts or omissions of customs officials, the authority of law, quarantine, riots, strikes, work stoppages or slowdowns, or other labor disputes or disturbances, civil commotions or hazards incident to a state of war, local or national disruptions in the ground or air transportation networks or systems due to events beyond our or shipping careers control, disruption or failure of communication and information systems, disruption or failure of utilities, or any circumstances beyond shipper’s control will not be granted any shipping (full or partial) refunds.

 

SECTION 7 - WARRANTY POLICY COVERAGE

We offer a limited-time warranty on all our products. This warranty covers the manufacturing defects for all the products purchased from Kiddie Couch’s website. A manufacturing defect is a deviation from design specifications during production resulting in a product's defect, frailty, or shortcoming.

7.1. How Long The Warranty Coverage Lasts?

The standard warranty for our products lasts for a total of 12 months (1 year). For the purpose of this policy, the warranty period shall commence from the date and time the product will be received by the customer. 

7.2. Conditions Under Which Warranty Is Not Covered

This warranty on our products does not cover any damage, deterioration, or malfunction resulting from any alteration, modification, improper or unreasonable use or abuse, misuse, fire, accident, neglect, exposure to excess moisture, malicious damage, excessive heat, using not properly, lightning, or other acts of nature. In continuity to the above statement, this warranty also does not cover any damage, deterioration, or malfunction resulting from the installation or removal of any products or item during bad installations, any unauthorized tampering with this product, any repairs attempted by anyone unauthorized person to make such repairs or any other cause which does not relate directly to a defect in materials and/or workmanship of this product.

7.3.  What Our Company Will Do?

We will provide one of the following solutions to whatever extent it shall deem necessary to satisfy a proper claim under this warranty policy within the allowed time limit.

  1. Repair or replace the defective product with a direct replacement or with a similar product deemed by our company to perform substantially the same function as the original product.
  2. In case we no longer have the same product available we will issue a credit of similar value as of the originally purchased product.

 

SECTION 8 - RETURN, REFUND ANC CANCELLATION POLICY

There are no returns and refunds on any of our products. All sales will be considered complete the final and the buyer cannot return any product.

 

8.1. Cancellation Policy

You can only cancel the order before it is shipped. Once your order is shipped, we cannot cancel it. If you would like to cancel an order before it is shipped, please contact us immediately at hello@kiddiecouch.ca.

 

SECTION 9 – DISPUTES

Any dispute arising from any of the products bought from Kiddie Couch’s website will be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration according to the civil law of Canada.
